Terms of Service

Please read these Terms of Service ("Terms") carefully before using DodoNest ("we", "our", or "us"). By accessing or using the DodoNest website at https://dodonest.app or the DodoNest iOS application (together, the "Service"), you agree to be bound by these Terms. If you do not agree, you must not use the Service.

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you and DodoNest. By creating an account or otherwise using the Service, you represent that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

2. Description of Service

DodoNest is a tribe management companion application for players of ARK: Survival Ascended. The Service allows tribe members to collaboratively manage servers, bases, dinosaurs, boss runs, tasks, and other in-game activities. The Service is provided "as-is" and may be modified, suspended, or discontinued at any time.

An active internet connection is required to use the Service. Certain features require a registered account.

3. Eligibility

You must be at least 13 years of age to use the Service. If you are between 13 and 18 years of age (or the age of majority in your jurisdiction), you must have the consent of a parent or legal guardian who agrees to these Terms on your behalf and accepts responsibility for your use of the Service.

By using the Service, you represent and warrant that you meet the eligibility requirements above and that you have the legal capacity to enter into these Terms.

4. Accounts

4.1 Account Creation

You may sign in using Apple, Google, or email/password. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at support@dodonest.app if you suspect unauthorized access to your account.

4.2 Account Accuracy

You agree to provide accurate and complete information when creating your account and to keep your profile information current. You may not impersonate any person or entity or use a display name that is offensive, misleading, or infringes on the rights of others.

4.3 One Account Per Person

Each person may maintain only one active account. The Service provides an account merge feature if you have accidentally created multiple accounts. Operating multiple accounts to circumvent bans or restrictions is prohibited.

4.4 Account Deletion

You may delete your account at any time from your profile settings. Upon deletion, all your personal data and tribe content will be permanently removed in accordance with our Privacy Policy. If you are the sole leader of a tribe, you must transfer leadership before your account can be deleted.

5. User Conduct

You agree that you will not use the Service to:

• Violate any applicable local, national, or international law or regulation.
• Harass, threaten, bully, defame, or intimidate other users.
• Post or transmit content that is obscene, hateful, discriminatory, or promotes violence.
• Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity.
• Attempt to gain unauthorized access to any part of the Service, other accounts, or any connected systems or networks.
• Introduce malware, viruses, or any other malicious code into the Service.
• Use automated scripts, bots, or scrapers to access the Service without our prior written consent.
• Interfere with or disrupt the integrity or performance of the Service or the data contained therein.
• Collect or harvest personal information about other users without their consent.
• Use the Service for any commercial purpose not expressly permitted by these Terms.

We reserve the right to investigate violations of this section and to take appropriate action, including removing content, suspending accounts, and cooperating with law enforcement authorities.

6. User-Generated Content

6.1 Your Content

The Service allows you to create, upload, and share content, including tribe names, base records, dinosaur names and descriptions, task descriptions, announcements, and marketplace listings (collectively, "User Content"). You retain ownership of your User Content.

6.2 License to Us

By submitting User Content to the Service, you grant us a non-exclusive, worldwide, royalty-free license to store, display, and transmit your User Content solely as necessary to provide the Service to you and your tribe members. We do not use your User Content for any other purpose.

6.3 Content Standards

User Content must not: be defamatory, obscene, or offensive; infringe any third-party intellectual property rights; contain personal information about third parties without their consent; or violate any applicable law. We reserve the right to remove any User Content that violates these standards.

6.4 Reporting Objectionable Content

If you encounter content on the Service that you believe violates these Terms or is otherwise objectionable, please report it to us at support@dodonest.app. We will review reports and take appropriate action. Marketplace listings can also be reported directly using the report button within the app.

7. In-App Marketplace

The Service includes a marketplace feature that allows tribes to publicly list dinosaurs, breeding pairs, dino collections, and boss run seats for other tribes to browse and claim. The marketplace facilitates coordination between players across different tribes; it does not process any real-money transactions and is not a financial service.

All marketplace transactions are arranged directly between the listing tribe and the claiming player. We are not a party to any in-game trade and are not responsible for any disputes arising from marketplace listings or trades. Users engaging in marketplace activity agree to abide by ARK: Survival Ascended's in-game rules and the policies of the platform on which the game is played.

8. Third-Party Game Disclaimer

DodoNest is an independent, fan-made companion application and is not affiliated with, endorsed by, sponsored by, or officially connected to Studio Wildcard, Snail Games, or any of their subsidiaries or affiliates.

ARK: Survival Ascended, ARK: Survival Evolved, and all related names, logos, and images are trademarks or registered trademarks of Studio Wildcard and/or Snail Games. Any use of these trademarks within the Service is solely for the purpose of identifying the game and is not intended to imply any endorsement or affiliation.

The in-game news displayed in the Service is fetched from the publicly available Steam API and is provided for informational convenience. We do not claim ownership of that content.

9. Intellectual Property

9.1 Our Property

The Service and its original content (excluding User Content and third-party game assets), features, and functionality are and will remain the exclusive property of DodoNest and its licensors. The Service is protected by copyright, trademark, and other applicable laws. You may not copy, modify, distribute, sell, or lease any part of our Service without our prior written consent.

9.2 Feedback

If you provide suggestions, ideas, or feedback about the Service ("Feedback"), you grant us an irrevocable, perpetual, royalty-free license to use that Feedback for any purpose without obligation to you.

10. Disclaimers

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT ANY WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT WARRANT THAT ANY DEFECTS WILL BE CORRECTED, OR THAT THE SERVICE OR THE SERVER THAT MAKES IT AVAILABLE ARE FREE OF VIRUSES OR BUGS.

Your use of the Service is at your sole risk. We are not responsible for any loss of in-game data, game progress, or outcomes in ARK: Survival Ascended that may result from the use of, or reliance on, information in the Service.

11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DODONEST, ITS OPERATORS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES — INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THE SERVICE, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW. IN ALL CASES, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ANY CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) USD $10.

Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by applicable law.

12. Indemnification

You agree to defend, indemnify, and hold harmless DodoNest and its operators, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) your violation of these Terms; (c) your User Content; or (d) your violation of any third-party rights, including intellectual property rights.

13. Termination

We reserve the right to suspend or terminate your access to the Service at any time and for any reason, including if we reasonably believe you have violated these Terms, with or without notice. You may terminate your account at any time by deleting it from the settings screen.

Upon termination: your right to use the Service ceases immediately; we will delete your personal data in accordance with our Privacy Policy; and any provisions of these Terms that by their nature should survive termination shall survive, including Sections 6.2, 9, 10, 11, 12, and 14.

14. Governing Law

These Terms are governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located in the Netherlands for the resolution of any dispute arising under these Terms.

If you are a consumer located in the European Union, you also have the right to submit a dispute to an alternative dispute resolution body. The European Commission's Online Dispute Resolution platform is available at https://ec.europa.eu/consumers/odr.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will update the effective date at the top of this page and, where required by law, provide notice via email or an in-app notification. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

If you do not agree with the revised Terms, you must stop using the Service and may delete your account.
